For custom software, website, or mobile app development, the scope of work will be clearly defined in the proposal or agreement shared with the client.
Any additional feature, modification, or change request that is not included in the original scope will be treated as extra work and may require additional charges.
4. Payment Terms
Clients agree to follow the payment schedule mentioned in the proposal, quotation, or invoice.
Failure to complete payment may result in:
- Suspension of services
- Delay in project delivery
- Temporary or permanent project termination
The company reserves the right to pause work until pending payments are cleared.
5. Refund Policy
Payments made for services such as software development, mobile app development, website development, or custom projects are non-refundable once work has started.
This is because development work requires allocation of time, effort, and technical resources.
Refund requests based on change of mind, project cancellation by the client, or third-party development decisions will not be accepted.
6. Delivery and Acceptance
Once a project, software, or application is delivered to the client, it will be considered completed as per the agreed scope of work.
Any new feature requests after delivery will be treated as separate work and may require additional charges.
7. Intellectual Property
All software code, designs, applications, and development materials remain the property of the company until full payment is received.
Ownership rights will only be transferred to the client after full payment of all agreed charges.
8. Misuse of Services
Users agree not to:
- Misuse our services or platform
- Make false allegations or fraudulent claims
- Attempt to damage the reputation of the company
- Harass or threaten team members
In such cases, the company reserves the right to suspend services and take appropriate legal action.
9. Chargebacks and Payment Disputes
If a client initiates a chargeback, payment dispute, or complaint after receiving services or products, the company reserves the right to:
- Suspend services immediately
- Restrict access to delivered systems
- Initiate legal action if required
10. Limitation of Liability
The company will not be responsible for any indirect losses, business losses, or damages arising from the use of our services.
Clients are responsible for how they use the software or services after delivery.
11. Jurisdiction
Any dispute, claim, or legal matter arising out of services, products, payments, or agreements with Kalam Academy, MG Tech Labs Private Limited, or any associated brands or companies operated by the same management shall be subject to the jurisdiction of Ranchi, Jharkhand, India only.
The user or client agrees that any legal complaint, dispute, or case must be filed only in courts located in Ranchi, Jharkhand.
